Terms of Sale

This contract hereof, between Homemakers Plaza Inc., seller, and the buyer, is subject to the following additional terms and conditions, to-wit:

 

BINDING AGREEMENT: This transaction shall not be a binding contract until said goods are delivered or tendered to the buyer.

 

MAINTENANCE: Buyer will keep the goods in good condition and free from liens and other security interests, will pay all taxes and assessments on them, and will not dispose of the goods or encumber them.

 

NOT A FIXTURE: The parties intend that said goods will not become fixtures nor shall the goods become accessions to other goods. It is not the intention of Homemakers to acquire or retain a security interest in any real estate, including the principal residence of the buyer.

 

SECURITY INTEREST: Until all payments due hereunder have been made, the seller retains a security interest in the goods described on their receipt of purchase. Buyer represents that the purchase of said goods hereunder is for personal, family, or household use, unless otherwise indicated, at the address shown on the receipt of purchase.

 

VENUE: This contract is executed in Des Moines, Iowa, and shall be construed under the laws of the state of Iowa, and the parties hereto agree that any action relating to this contract may be instituted and prosecuted in the courts of Des Moines, Polk County, Iowa, and each party hereto hereby waives the right to change of venue.

 

LIMITATION OF DAMAGES: Buyer agrees that Homemakers shall not be liable for consequential damages resulting from any breach of this contract. Buyer’s remedies for breach are limited to the return of the goods and refund of the purchase price, or at Homemakers' option, to the repair and/or replacement of nonconforming goods or parts.

 

ERRORS: Pricing, mathematical, and inadvertent errors are subject to revision by the seller.

 

CHECKS: The maximum charge allowed by law will be assessed on any check returned by the buyer’s bank without payment. Homemakers reserves the right to demand payment by cash or certified check. If the buyer’s check is dishonored for any reason, the unpaid balance will bear interest at the maximum legal rate from the date of tender.

 

MISCELLANEOUS: (a) Loss or damage to goods will not release Buyer. (b) If any part of this contract is adjudged invalid, the remainder will not thereby be invalidated. (c) Homemakers is hereby appointed Buyer’s attorney-in-fact to do all acts and things which Homemakers may deem necessary to perfect and continue perfected the security interest created by this contract and to protect the goods. (d) This writing contains the full, final, and exclusive statement of the contract of the parties. (e) Buyer agrees that no interest will be paid on deposits or down payments reflected on the face of this contract, or on any credit balance. (f) A photographic reproduction of this contract may be filed as a financing statement. (g) Buyer agrees to pay all state and local sales tax, whereas local tax is determined by the possession of goods.

 

PICK-UP INFORMATION: Your order will be pulled and loaded into your vehicle after you arrive. For your protection, a picture ID and order ID are required to release furniture to you. We can assist you in tying down merchandise, but we are not responsible for the merchandise/vehicle after it has left the premises.

 

CANCELLATION & RETURN POLICY: Merchandise re-selection or returns are available on merchandise, including clearance items purchased online. However, this policy excludes in-store clearance, custom orders, bed products (mattress, box spring, bed pillows, adjustable bases), and delivery charges. The item must be in its original condition and accompanied by a sales receipt within 30 days after pickup or delivery. Shipping and delivery charges are non-refundable. The cost of return shipping or delivery will be deducted from your refund.

 

PAYMENT: All purchases require a minimum deposit of 25% and must be paid in full before the merchandise is picked up or scheduled for shipping/delivery. We accept Homemakers/NFM Card, MasterCard, VISA, Discover, American Express, Bank Debit Cards, Apple Pay, Google Pay, PayPal, and Affirm Financing for online purchases. Personal checks, cash, NFM gift cards, bank cashier’s checks, and money orders will be accepted for in-store purchases only. No starter or temporary checks will be accepted. All checks will be deposited upon receipt. Homemakers will not hold checks. Merchandise must be picked up, scheduled for shipping/delivery, or paid in full within 30 days after being received by Homemakers. Financed orders are not considered paid-in-full and may require monthly payments by other means prior to you taking possession.

The Homemakers/NFM Card is a revolving charge account similar to MasterCard or VISA. Simply fill out an application at a Nebraska Furniture Mart or Homemakers store location, and we will process it for you. Upon approval, a charge account will be opened for you. This card is good at all Homemakers and Nebraska Furniture Mart Locations.

 

REFUND POLICY: Refunds will be issued on merchandise upon return of the merchandise to Homemakers, excluding custom orders, in-store clearance, bed products (mattress, box spring, bed pillows, adjustable bases), and shipping/delivery charges. Refunds are processed in the same manner as the payment was received, except for cash and gift cards. Cash payments will be refunded via corporate check. For gift cards, Homemakers will issue a new gift card for the amount being refunded. Expect card refunds to take up to 7 business days.

 

ATTORNEY FEE: In the event litigation is necessary to enforce the seller’s rights hereunder, buyer agrees to pay a reasonable attorney fee and court costs, except for those transactions governed by the consumer credit code.

 

IN-STORE CLEARANCE MERCHANDISE / FLOOR MODELS: In-Store Clearance Merchandise (“AS IS”) and Floor Models must be scheduled for shipping/delivery or picked up within three days; otherwise, merchandise will be made available for sale, and your deposit will be refunded via a gift card. “AS IS” merchandise is sold without warranties or guarantees. “AS IS” sales are final. NO refunds. NO returns. NO guarantees. NO exchanges.

 

SPECIAL ORDER MERCHANDISE: Seller cannot guarantee the actual shipping/delivery, or the shipping/delivery date, of special order merchandise, and any shipping/delivery set forth on the face hereof is an estimate only and not a guarantee. Cancellation of a special order by the buyer will result in a 25% restocking fee. The 25% restocking fee may not be financed using a Homemakers/NFM Card.

 

120-NIGHT COMFORT GUARANTEE: Our 120-Night Comfort Guarantee is valid on all mattresses where a Homemakers mattress protector/pad is purchased. Mattresses purchased without a Homemakers mattress protector/pad are final with no returns. Within 120 days of receiving your mattress, you are allowed a one-time reselection with a $69.99 restocking fee. Stains and/or soiling void the comfort guarantee and manufacturer's warranty. No returns or exchanges will be allowed. Mattress protectors/pads cannot be returned or exchanged. Adjustable bases and box springs can be returned or exchanged within 30 days. Regular in-home delivery fee applies to all delivered exchanges, returns, and comfort guarantees. Delivery fees are non-refundable. Any reselection for less than the original price paid will be issued as in-store merchandise credit. Any free product or reward card with a mattress purchase will be deducted from any credit if reselection doesn’t qualify. Extended financing terms on specialty beds will be void when reselecting another brand that doesn’t qualify. Comfort guarantee excludes mattresses purchased without a mattress protector/pad, clearance mattresses, custom orders, floor models, pillows, sheets, and mattress protectors/pads. Mattress returns outside of this policy are subject to additional restocking fees or denial of return.

 

BEST PRICE GUARANTEE: Within 30 days of receiving or picking up your Homemakers purchase, in the unlikely event you find the exact same merchandise advertised or displayed as currently in stock for less at a different authorized dealer, just bring in written proof. A Homemakers sales manager will verify the accuracy/legitimacy of the price, taking into account variables including, but not limited to, promotional pricing, applicable sales tax, delivery charges, and shipping time. Upon verification, we will gladly issue a refund for 100% of the price difference to the original form of payment. This guarantee does not apply to special financing, bonus offers, rebates, limited quantity offers, clearance, closeout, or out-of-the-box merchandise or custom orders.

 

SERVICE INFORMATION: At Homemakers, our goal is to provide customer satisfaction by providing an enjoyable buying experience, as well as standing behind our products with professional service and stated warranties.

  • Upholstery: One (1) year warranty against manufacturer’s defect. Manufacturer frame warranties will be honored. Mechanisms are subject to the manufacturer’s warranties. Note: Dye lot variances, piling, fading, normal wear, and soiling in the home are not covered under warranty unless otherwise stated by the manufacturer.
  • Leather: One (1) year warranty against manufacturer’s defect. Manufacturer frame warranties will be honored. Note: Leather characteristics add to the appearance and personality of each piece of furniture. Wrinkles and marks (bug bites, scars, brands, etc.) are trademark characteristics typical of genuine leather.
  • Wood Products: One (1) year warranty against manufacturer’s defect. Note: Solid and veneer wood products may show variations in grain qualities and/or natural blemishes. These characteristics provide real wood products with their unique and authentic beauty.
  • Bedding: Homemakers strictly adheres to the manufacturer’s warranties. An inspection of the bedding may be required by the manufacturer.
  • Area Rugs: One (1) year warranty against manufacturer’s defects. Note: Area rug maintenance will extend the life and beauty of your purchase. Rotate rugs periodically to avoid pattern wear and pile crushing. Cleaning stains immediately, vacuuming regularly and avoiding direct sunlight will prevent fading and will increase your rug’s life span.
  • Accessories: We ask that you carefully inspect all items prior to purchase. No warranty applies to accessories. Note: Bulbs provided in lit merchandise are not warranted.

Procedure: It is your responsibility to inspect your merchandise upon receiving it and to report any claims to our Customer Service Department within 10 days of pick up, delivery, or shipping. You must have your receipt for the above warranties to apply.

Homemakers reserves the right to:

  • Inspect the damaged merchandise in the customer’s home.
  • Service in your home, our warehouse, or at the factory.
  • Repair or replace at the discretion of the Customer Service Department.

Homemakers strives to ensure customer satisfaction through professional service, and that the conditions above apply only with normal use and against manufacturer's defect. All services will be provided within our delivery schedule. Transportation and labor fees will be provided at no charge for one (1) year from the date of purchase. Homemakers Furniture is not warranted for commercial use.
